I will be polite and courteous to the person whose land I am picking produce on and the other people picking produce. If asked to leave a property I will without question. I will not sell the produce I pick.
I agree to this liability waiver to not hold another party liable for damages or injury that may occur during harvesting.
I will not hold employees or volunteers of Share the Harvest and its affiliates liable for injury, bodily harm, accidents or death of myself/my child during produce harvesting events.
I will not hold the person(s) who own and/or operate either the property from which I/my child, friends and family harvest produce, or the property to which the produce is delivered liable for accidents, injury, or death while participating in harvesting related activities.
Liability Release Agreement
I hereby acknowledge and agree that:
Participation is at my own risk: I understand that I and/or my child(ren) are voluntarily participating in Events on private and/or public property, that participation in these Events may involve outdoor labor, and certain hazards and dangers may exist and occur while participating in the Event. I further understand and agree that that my and/or my child(ren)’s presence on such property and use of equipment made available by Share The Harvest, the Property Owner, and/or their agents and affiliates is entirely at my own risk.
I release liability (I hold everyone harmless): In consideration of my and/or my child(ren)’s participation in the event, I hereby release Share The Harvest, the property owner, and their agents separately and collectively, from any and all claims, demands, causes of actions, damages, and liabilities, whether currently known or unknown, which are or may be in anyway connected with the event.
Applicability of Liability Release (do these terms apply to me?) I understand that in some jurisdictions the limitations of liability set forth in this liability release may not apply to me. If any provision of this liability release is held to be contrary to the law, I agree that such provision will be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by the law, and if no feasible interpretation will save such provision, it shall be deleted, and the remaining provisions will remain in full force and effect.
I have read this Agreement: I agree that my voluntary signature below indicates that I have read and understand these terms and the consequences of the releases and I am fully aware of the legal and binding effect of my signature. I am signing below without any duress or undue influence on the part or behalf of any other party, with the full intent of releasing all claims against Share The Harvest, the Property Owner and their agents and affiliates.
It’s okay to take and use my picture: I grant Share The Harvest permission to copyright and use my voice and likeness of me in any manner of form for any lawful purpose at any time. I waive any right that I may have to inspect or approve the finished product.
This agreement will remain in force for all Share The Harvest activities until revoked or replaced by either Share The Harvest or the signer.
